Beste leden van het OPT,

Op 6 juli is de internetconsultatie gestart van het wetsvoorstel tot implementatie van de Europese richtlijn kostenreductie breedband (zie link http://www.internetconsultatie.nl/wibon).

Het wetsvoorstel bevat maatregelen met als doel de kosten voor de aanleg van breedbandnetwerken te reduceren. De belangrijkste maatregelen in de richtlijn breedband betreffen:

1. Netwerkexploitanten worden verplicht om in te stemmen met medegebruik van bestaande fysieke infrastructuur door aanbieders van breedbandnetwerken. Onder het begrip netwerkexploitanten in de zin van de richtlijn vallen behalve alle
aanbieders van een openbaar elektronisch communicatienetwerk ook andere zogenoemde nutsbedrijven die infrastructuur aanbieden, zoals de netbeheerders voor elektriciteit (inclusief straatverlichting), gas, verwarming, water, afval- en rioolwater
alsmede beheerders van spoorwegen, wegen, havens en luchthavens.
2. Rechthebbenden op fysieke binnenhuisinfrastructuur en toegangspunten in een gebouw worden verplicht te gedogen dat deze infrastructuur en toegangspunten worden gebruikt door aanbieders van breedbandnetwerken.
3. Netwerkexploitanten worden verplicht om bij de uitvoering van civiele werken ten behoeve van de fysieke infrastructuur van hun net te coördineren met civiele werken van aanbieders van breedbandnetwerken.
4. Netwerkexploitanten worden verplicht informatie te verstrekken aan aanbieders van breedbandnetwerken op grond waarvan een verzoek om medegebruik van fysieke infrastructuur om coördineren kan worden gedaan.
5. Ten slotte wordt de huidige verplichting geschrapt dat aanbieders van openbare telecommunicatienetwerken na 10 jaar hun ongebruikte kabels en fysieke infrastructuur zoals leidingen en mantelbuizen uit de grond halen (opruimen).
